These Terms and Conditions govern your access and use of the website and services provided by EverTrace Testing Services LLC ("EverTrace," "we," "our," or "us"). Please read these Terms carefully before using our services. By accessing or using our site or services, you agree to be bound by these Terms.
1. Binding Arbitration
All disputes between you and EverTrace must be resolved through final, binding, and confidential arbitration on an individual basis. This means you may not bring claims as part of a group, class, or representative action. See Section 19 for full details on arbitration.
2. Cautions
Accuracy of test results may be affected by improper sample collection. EverTrace is not responsible for testing errors caused by sample contamination or failure to follow instructions. We make no guarantees regarding the accuracy, reliability, or specific outcomes of our services.
3. Medical Advice Disclaimer
Our services and content are for informational purposes only and do not constitute medical advice. In the event of a medical emergency, call 911 or contact your healthcare provider. We do not diagnose, treat, or provide medical guidance.
4. Definitions
((a) "Conditions" – These Terms & Conditions
(b) "Contract" – Any order for services by you and accepted by EverTrace
(c) "Kits" – Sample collection kits provided by EverTrace
(d) "Request Form" – The service order form available on our site
(e) "Service" – Testing services and related offerings provided by EverTrace
(f) "Site" – the EverTrace platform or any affiliated platform
(g) "You" – Any individual who places an order or uses our Site/services
5. Terms of Sale
5.1 These Terms govern all content on the Site and all orders placed with EverTrace.
5.2 By submitting an order, you legally agree to purchase under these Terms.
5.3 Orders are accepted at EverTrace’s discretion and become binding once accepted.
5.4 Prices and features are subject to change without notice.
5.5 These Terms do not affect your statutory consumer rights.
6. License to Use Site
You are granted a limited, non-transferable license to access the Site for personal use. No content may be copied, sold, or exploited commercially without prior written consent from EverTrace.
7. Prices, Payment, and Delivery
7.1 Prices are listed on our Site or in official written quotes.
7.2 We reserve the right to change prices due to cost changes or errors.
7.3 Payment must be completed before services are rendered.
7.4 You are responsible for all transaction taxes.
7.5 You confirm all payment and billing information is accurate.
7.6 Payments are processed by third-party vendors.
7.7 Charges for completed services are final unless EverTrace decides otherwise.
8. Cancellations, Refunds, and Order Changes
8.1 You may cancel within 3 business days (excluding weekends and holidays) of order acceptance, unless samples have been collected, testing has started, or kits have been dispatched.
8.2 Refunds, where applicable, will be issued within 30 days of cancellation notice.
8.3 Damaged kits may be replaced or refunded at EverTrace’s discretion.
8.4 We reserve the right to cancel or refuse any order.
8.5 Service delivery timelines are estimates.
8.6 If a result is found to be erroneous, a re-test or refund may be offered.
9. Non-Refundable Affiliate Fees & Promotion Disclaimer
All affiliate fees are non-refundable. EverTrace is not obligated to promote partner businesses. Promotional support is offered solely at our discretion.
10. Your Responsibilities
10.1 Submit uncontaminated samples following Kit instructions.
10.2 Ensure you have legal rights to submit third-party samples.
10.3 Be of legal age and mental soundness.
10.4 Use the Site and Services legally.
10.5 You may not use our Service for insurance or employment discrimination purposes.
10.6 You acknowledge that results may be emotionally impactful.
10.7 You waive rights to commercial products developed using your sample.
11. Account Creation & Security
11.1 You must provide accurate and up-to-date information.
11.2 You are solely responsible for your account activity.
11.3 Maintain the confidentiality of your account and test results. Test results will be sent by email, and it is your responsibility to safeguard access to your email account. EverTrace is not responsible for any loss, unauthorized access, or disclosure of information resulting from a security breach or misuse of your email.
11.4 Report unauthorized access immediately.
12. Privacy
Your personal information is handled according to our Privacy Policy. Please review it before using our Site or Services.
13. Restrictions
You may not:
- Breach Site security
- Use bots or scrapers
- Disrupt Site operations
- Upload malicious code
- Violate any laws
All User Generated Content (UGC) submitted to EverTrace becomes our property, and we may use it freely without compensation.
14. Third-Party Links
We are not responsible for the content or accuracy of third-party websites linked on our Site.
15. Disclaimer & Limitation of Liability
15.1 The Site and Services are provided "as is" and "as available."
15.2 We make no guarantees regarding result acceptance by legal entities.
15.3 Our liability is limited to $150 or the amount you paid, whichever is less.
15.4 Claims must be made within one year.
15.5 Nothing limits liability for death or injury caused by negligence.
16. Copyright
All content on our Site is the intellectual property of EverTrace or its licensors. You may download content only for personal use related to Services.
17. Third-Party Rights
These Terms do not grant enforceable rights to any third parties, except affiliates, directors, employees, or representatives of EverTrace.
18. Governing Law
These Terms are governed by the laws of the State of Alabama, USA. You may also have additional rights under applicable federal laws such as the Federal Arbitration Act, the Electronic Signatures in Global and National Commerce (E-SIGN) Act, and the Communications Decency Act (CDA), where applicable. These laws may affect your use of this Site and the Services and your rights regarding dispute resolution and consent to electronic communications.
19. Agreement to Arbitrate
All disputes will be resolved through binding arbitration under the rules of JAMS. Class actions are waived. Arbitration costs are shared equally unless otherwise decided.
20. General Provisions
These Terms represent the entire agreement. If any part is found unenforceable, the remainder still applies. EverTrace is not responsible for events beyond its control.

Return and Refund Policy
Effective Date: May 20, 2025
At EverTrace Testing Services LLC ("EverTrace"), we strive to provide clear and professional service expectations. Please review our refund and cancellation policy below:
1. Final Sales Policy
All sales are considered final once any of the following have occurred:
- DNA kits or collection supplies have been shipped;
- Testing services have commenced; or
- A sample collection appointment has been completed.
Once testing begins, refunds will not be provided under any circumstances.
2. Appointment Cancellation
- Appointments cancelled at least 24 hours in advance of the scheduled time may be cancelled without penalty.
- Same-day cancellations are subject to a $50 administrative service fee.
3. Rescheduling and Recollection
- If a recollection is required and a participant is unable or unwilling to comply, no refund will be issued.
- Rescheduling may be offered once at EverTrace’s discretion. A second cancellation or no-show may result in forfeiture of fees.
4. Turnaround Times
Estimated result delivery timelines are discussed during scheduling and confirmed at the time of sample collection. While we make every effort to deliver results promptly, EverTrace is not responsible for delays due to uncontrollable circumstances, including lab processing time, shipping interruptions, or participant-related issues.
